IALING: THE NEW FRONTIER - TERMS OF SERVICE AND END USER LICENSE AGREEMENT

These terms are the agreement between you and Eclectic Eight Holdings LLC, doing business as Gravity Line Studio, for playing Ialing: The New Frontier. They also serve as the End User License Agreement for the software. Please read Sections 11 through 14, which limit our liability and set out how disputes are resolved.

1. ACCEPTANCE

These Terms of Service and End User License Agreement (the "Terms") form a binding agreement between you and Eclectic Eight Holdings LLC, a Wyoming limited liability company doing business as Gravity Line Studio ("Gravity Line Studio", "we", "us"), governing your use of Ialing: The New Frontier (the "Game") and any related services, updates, and websites we operate.

You accept these Terms when you tap to accept them at first launch, or by continuing to play. If you do not accept them, do not play the Game.

2. ELIGIBILITY

You must be at least 13 years old to play. If you are in the European Economic Area, you must be at least 16, or the minimum age set by your country. If you are under the age of majority where you live, you may only play with the involvement of a parent or guardian who accepts these Terms on your behalf.

You may not play if you are barred from doing so under the laws of your country or of the United States, including applicable sanctions and export-control rules.

3. YOUR ACCOUNT

The Game creates an account for you on first launch. By default this account is anonymous and tied to your device. You may optionally link a username and password so your progress survives reinstalling or changing devices.

You are responsible for keeping your credentials secure and for all activity under your account. One person may hold one account unless we say otherwise in writing. Accounts may not be sold, rented, or transferred.

AN UNLINKED ANONYMOUS ACCOUNT CAN BE PERMANENTLY LOST if you uninstall the Game, reset your device, or delete the account. We cannot recover it. Link your account if your progress matters to you.

You may request account deletion through Profile > Settings in the Game, or at https://ialing.web.app/ for a linked username/password account without reinstalling. Account ownership must be verified. Never email your password to the studio. Deletion is permanent and irreversible. Processing continues after you close the app, takes at least 65 minutes to allow existing sessions to expire, and may take longer. Request acceptance does not mean completion; use the recovery receipt/status page to confirm completion. Limited security, abuse and completion records are retained as described in the Privacy Policy. Uninstalling alone does not request account deletion.

If the deleting account leads an alliance, leadership transfers to an eligible remaining member where possible; an alliance with no remaining members is removed.

4. LICENCE TO PLAY

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and play one copy of the Game on a device you own or control, for your own non-commercial entertainment.

You may not:
- Copy, modify, translate, or create derivative works of the Game, except where such restriction is prohibited by applicable law
- Reverse engineer, decompile, or disassemble the Game or attempt to derive its source code
- Distribute, sell, rent, lease, or sublicense the Game, or host it on any server
- Remove or obscure any copyright, trademark, or other proprietary notice
- Use bots, scripts, macros, memory editors, modified clients, or any automated or unauthorised means to play or to gain an advantage
- Exploit bugs or errors rather than reporting them
- Access the Game's servers or APIs other than through the unmodified Game or our official account-management website

This is a licence, not a sale. All rights not expressly granted are reserved.

5. OWNERSHIP AND INTELLECTUAL PROPERTY

The Game and everything in it is owned by Eclectic Eight Holdings LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. This includes, without limitation:
- The software, source code, and systems
- The setting of Ialing and its fiction, history, and factions, including the Rolags, the Nahari, the Verath, the ARC pods, the ship AI known as DMG, and the twenty-five moons
- Characters, creatures, place names, artifacts, and story text
- Art, models, interface design, music, and sound
- The names "Gravity Line Studio", "Ialing", and "Ialing: The New Frontier", together with associated logos and marks

You may create and share screenshots, recordings, streams, and other non-commercial fan content featuring the Game, provided you do not imply that we endorse it, do not present it as an official product, and do not use it in a way that is unlawful or that disparages the Game. We may revoke this permission at any time. This permission does not license our trademarks for merchandise or commercial use.

6. RULES OF CONDUCT

While playing, you agree not to:
- Harass, threaten, defame, stalk, or abuse other players
- Post content that is hateful, obscene, sexually explicit, or that promotes violence or discrimination
- Impersonate another person, our staff, or any official channel
- Share other people's personal information
- Advertise, spam, or solicit, including selling accounts or in-game items for real money
- Cheat, exploit, or interfere with other players' ability to play
- Attempt to disrupt, overload, or gain unauthorised access to our systems or those of our providers
- Use the Game for anything unlawful

7. CONTENT YOU CREATE

You are responsible for the display names, alliance names and descriptions, chat messages, forum posts, and any other content you submit ("Your Content"). You keep ownership of Your Content.

By submitting it, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, and distribute Your Content for the purpose of operating and promoting the Game, subject to the audiences and privacy choices described in the Privacy Policy. We do not use private messages for public promotion. This licence continues only to the extent necessary for content lawfully retained under that policy, including restricted abuse evidence. Account deletion removes your authored message contents and public attribution, leaving neutral deletion markers where needed.

We may review, moderate, edit, refuse, or remove any content, and may suspend accounts that break these rules, but we do not promise continuous monitoring or endorse anything players post. World and region channels are shared with other players; alliance channels are for authorized alliance participants. Private messages are for their participants, are not end-to-end encrypted, and may be reviewed by authorized studio staff when reported for safety. Non-alliance conversations begin with a message request. Use the available report and block controls or contact support about abuse. Do not disclose sensitive personal information in shared channels.

8. IN-GAME ITEMS AND PROGRESS

The Game is currently offered free of charge and contains no in-app purchases. Resources, buildings, troops, research, artifacts, levels, alliance standing, and every other in-game element are licensed features of the software, not property.

They have NO MONETARY VALUE, cannot be redeemed for money or anything of value outside the Game, and may not be traded or sold for real currency. We may change, rebalance, add, or remove any in-game element, and may adjust or reset progress where necessary to fix bugs, correct exploits, or maintain fair play.

If we introduce paid content in a future version, we will publish updated Terms covering purchases and ask you to accept them before those features become available to you.

9. AVAILABILITY AND CHANGES

The Game is an online service and depends on third-party platforms. We do not promise uninterrupted availability. We may update, modify, suspend, or discontinue the Game or any feature, in whole or in part, at any time, with or without notice.

If we permanently discontinue the Game, we will make reasonable efforts to give advance notice through the Game or our website. Because the Game is free and no purchases exist, no refund obligation arises on discontinuation.

10. SUSPENSION AND TERMINATION

We may suspend or terminate your account and licence at any time if you breach these Terms, if we reasonably suspect cheating, abuse, or unlawful activity, or if we discontinue the Game. Where practical and appropriate we will tell you why.

You may stop playing at any time by uninstalling the Game, but uninstalling does not delete your online account. To request account deletion, use Section 3. Sections 5, 7, 8, and 11 through 16 survive termination, subject to the Privacy Policy's deletion and retention provisions.

11. DISCLAIMER OF WARRANTIES

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAVITY LINE STUDIO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT SAVE DATA WILL NEVER BE LOST.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing in these Terms limits any non-waivable statutory rights you have as a consumer.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAVITY LINE STUDIO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR GAME PROGRESS, ARISING OUT OF OR RELATING TO THE GAME, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE GAME WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) TWENTY-FIVE UNITED STATES DOLLARS.

Nothing here excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded.

13. INDEMNITY

You agree to indemnify and hold harmless Eclectic Eight Holdings LLC and its members and agents from any claim, damage, loss, or expense, including reasonable legal fees, arising from Your Content, your breach of these Terms, or your misuse of the Game, except to the extent caused by our own wrongdoing.

14. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules, and without limiting any mandatory consumer protections of the country in which you reside.

Before starting any formal proceeding, please email support@gravitylinestudio.com describing the problem. Most issues can be resolved informally, and we will try in good faith to do so within 30 days.

Arbitration and class waiver.
If a dispute is not resolved informally, you and Gravity Line Studio agree that it will be settled by binding individual arbitration administered under the rules of a recognised arbitration provider, rather than in court, and that neither party will bring a class, collective, or representative action. Either party may still bring an individual claim in small-claims court.

YOU MAY OPT OUT of this arbitration agreement by emailing support@gravitylinestudio.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.

If you are a consumer resident in the European Union or the United Kingdom, this section does not deprive you of the right to bring proceedings in the courts of your country of residence.

15. PLATFORMS AND THIRD-PARTY SERVICES

Your use of the Game is also subject to the terms of the platform you obtained it from, including Google Play. The Game relies on Unity Gaming Services and Google Firebase; those providers process data as described in our Privacy Policy.

The platform provider is not a party to these Terms and is not responsible for the Game or for support. Where the Game is distributed through the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you, and any claim that the Game fails to conform to a legal warranty is our responsibility rather than Apple's.

16. CHANGES TO THESE TERMS

We may revise these Terms as the Game develops. The effective date and version at the top will change accordingly. If a revision is material, the Game will ask you to review and accept the new version before you continue playing. Continuing to play after a change means you accept it.

17. GENERAL

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Game.
